GLASSEST TERMS AND CONDITIONS

These Terms and Conditions ("Terms") govern your use of the GlassEst application ("App") provided by Braemar Sales Ltd trading as GlassEst ("we", "us", or "our"). By subscribing to and using the App, you ("User" or "you") agree to be bound by these Terms.


1. SERVICE DESCRIPTION

1.1 GlassEst is a subscription-based glass estimating application that allows users to create quotations for their clients based on their own stock files, rates, and pricing.

1.2 The App enables you to input glass specifications, client details, and pricing information to generate professional quotations for your business.

1.3 We are committed to continuous improvement of the App and may update features and functionality from time to time.


2. SUBSCRIPTION AND PAYMENT

2.1 The App is available on a subscription basis with monthly or yearly payment options.

2.2 All subscription fees must be paid in advance via Direct Debit.

2.3 Payment is due at the start of each subscription period (monthly or yearly, as applicable).

2.4 Non-payment of subscription fees will result in immediate suspension of access to the App until payment is received.

2.5 Prices are subject to change with 30 days' written notice to subscribers.


3. CANCELLATION POLICY

3.1 Monthly Subscribers: You may cancel your subscription at any time. Cancellation will take effect at the end of your current monthly billing period. No refunds will be provided for partial months.

3.2 Yearly Subscribers: You may cancel your subscription at any time. Cancellation will take effect at the end of your current yearly subscription period. No refunds will be provided for unused portions of the year.

3.3 To cancel your subscription, you must provide written notice via email to our support team.

3.4 Upon cancellation, you will lose access to the App and all data stored within it at the end of your subscription period.


4. DATA COLLECTION AND STORAGE

4.1 The App collects and stores:

· a) User account information and business details

· b) Client data entered by you, including names, addresses, telephone numbers, and email addresses

· c) Stock files, rates, and pricing information you input

· d) Quotations and project data you create

4.2 You are responsible for ensuring you have appropriate consent and legal basis to collect and store any client data you enter into the App.

4.3 You must comply with all applicable data protection laws, including the UK GDPR and Data Protection Act 2018, when using the App.

4.4 We process data in accordance with our Privacy Policy, which should be read in conjunction with these Terms.


5. USER RESPONSIBILITIES

5.1 You are solely responsible for:

· a) The accuracy of all data, rates, and pricing you input into the App

· b) Verifying all calculations and quotations generated by the App before sending them to your clients

· c) Ensuring the accuracy of all client information you enter

· d) Maintaining the confidentiality of your account login credentials

5.2 You must perform thorough checks on all data and calculations prior to using the App to produce quotations for your clients.

5.3 You must not use the App for any unlawful purpose or in any way that could damage, disable, or impair the App.


6. LIMITATION OF LIABILITY


6.1 THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

6.2 We shall not be liable for:

· a) Any loss of data, whether caused by technical failure, user error, or any other reason

· b) Any loss of profits, revenue, or business opportunities arising from your use of the App

· c) Any errors in calculations or quotations generated by the App

· d) Any decisions made based on information produced by the App

· e) Any indirect, consequential, or incidental damages

6.3 You acknowledge that the App is a tool to assist with quotation preparation and that final responsibility for all quotations rests with you.

6.4 Our total liability to you for any claims arising from your use of the App shall not exceed the total subscription fees paid by you in the 12 months preceding the claim.

6.5 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.


7. INTELLECTUAL PROPERTY

7.1 All intellectual property rights in the App, including software, design, and documentation, belong to Braemar Sales Ltd.

7.2 You retain ownership of all data you input into the App, including your stock files, rates, and client information.

7.3 You are granted a non-exclusive, non-transferable license to use the App for the duration of your subscription.


8. SUPPORT SERVICES

8.1 We provide email support to all subscribers.

8.2 We aim to respond to support queries within 24-48 hours during business days.

8.3 Reported bugs will be addressed as soon as reasonably possible, though we cannot guarantee specific resolution timeframes.

8.4 Support is provided in English only.


9. APP UPDATES AND MODIFICATIONS

9.1 We reserve the right to modify, update, or discontinue any features of the App at any time.

9.2 We will make reasonable efforts to notify users of significant changes to the App.

9.3 Continued use of the App following any modifications constitutes acceptance of those changes.


10. TERMINATION

10.1 We reserve the right to suspend or terminate your access to the App immediately if:

· a) You breach these Terms

· b) You engage in fraudulent activity

· c) Your use of the App poses a security risk

· d) You fail to pay subscription fees when due

10.2 Upon termination for breach, no refund of subscription fees will be provided.


11. DATA BACKUP

11.1 While we implement reasonable security measures, you are strongly advised to maintain your own backup copies of important data.

11.2 We are not responsible for any data loss and recommend regular export or backup of your critical information.


12. GENERAL PROVISIONS

12.1 These Terms constitute the entire agreement between you and Braemar Sales Ltd regarding the use of GlassEst.

12.2 If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force.

12.3 Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

12.4 These Terms are governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12.5 We may update these Terms from time to time. Users will be notified of material changes via email, and continued use of the App constitutes acceptance of the updated Terms.
